Ferry is a mobile-first, short-term electric vehicle leasing company. Our optimized app allows people to browse, qualify for, reserve and go into contract on all-new EVs.
The General Terms & Conditions (“Terms & Conditions”) describe how Ferry will manage the vehicle subscription and any additional services. The terms in this definition refer to guidelines that both parties need to follow when signing the vehicle Lease Agreement. By accepting the vehicle Lease Agreement, the Subscriber agrees to comply with the Terms and Conditions, which may be amended from time to time to the extent permitted by law and, when required by applicable law, upon reasonable notice. The new Terms & Conditions apply to any new Lease Agreements, but will not affect your existing Lease Agreement.
By agreeing to this document, you are not entering into a Lease Agreement with us. You have only entered a Lease Agreement with us once you have signed the vehicle Lease Agreement. Your existing Lease Agreement controls to the extent it conflicts with the applicable Terms & Conditions.
It is important that you read the Terms & Conditions very carefully and that you understand them before placing a subscription order in our app. By clicking 'I accept', you agree to be bound by the Terms & Conditions.
You must agree to all the terms in this General Terms and Conditions document before you start a Lease Agreement with us. Due to Ferry's mobile-first business model, vehicle orders can be placed only through the Ferry app. In order to place a vehicle order, you must, as determined in Ferry’s sole discretion:
a) accurately, truthfully, and fully complete the leasing steps solely through the Mobile App;
b) submit all information and documents requested in the app: full legal name, current address, a valid driver's license, payment method, proof of insurance, and SSN number for the credit check;
c) meet the Eligibility Criteria; and
d) sign the Lease Agreement and make the initial payment. The initial payment is an amount equal to one monthly subscription payment, plus the delivery fee.
We will fully refund the initial payment, if, after making the payment, the vehicle order does not proceed for whatever reason and you will not be responsible for any early termination liability.
2.1. To be eligible to place a vehicle order, you must meet, as determined in Ferry’s sole discretion, the eligibility criteria outlined below:
a) a minimum of twenty-five (25) years of age;
b) possess a valid U.S. driver's license to satisfy the identification and verification process;
c) the address on your Ferry account is your primary address and is the address where the vehicle will be kept for the duration of the Lease Agreement;
d) have a valid credit card as a payment method; and
e) meet the credit check requirements determined by Ferry in its sole discretion.
2.2. Driving license conditions
a) you hold a full and valid U.S. driver’s license in the relevant category permitting you to drive a vehicle;
b) you have not been disqualified from driving within the last three years;
c) the address on your driver’s license should be the same as your home address; we will conduct a d) manual inspection if contrary; and
d) your driver’s license does not contain any endorsements that would prevent you from using or continuing to use our subscription services; this may include, but is not limited to: convictions for dangerous driving, drunk driving, drug-related driving, or failure to report an accident; and motoring offenses resulting in a suspension or disqualification of driving.
2.3. Adding a co-lessee
According to current business policies, you cannot add a co-lessee to a vehicle lease contract. Unauthorized drivers may not drive the vehicle under the terms of the Lease Agreement.
2.4. Holding a non-U.S. driver’s license
We will not be able to provide a vehicle subscription to anyone who does not hold a US driver's license.
2.5. Changes of your personal details
You agree to provide us with accurate information. Any changes to your address, name or contact information must be notified to us in a timely manner but no less than 10 days in advance. Once you start the leasing order, you will not be able to change the personal information in the Ferry app. Please contact us at firstname.lastname@example.org if you need to make any changes.
You must register for an account in our Ferry app before you can order a vehicle. Ensure that you keep your Ferry Account details private and do not divulge them to anyone.
3.1. To place an order in our app, you need to follow these instructions:
A. Create a vehicle order;
a) select your preferred vehicle;
b) select your preferred subscription term;
c) upload photos of your driving license that are clearly legible (front, back, and front with your face in close proximity);
d) enter your SSN number and allow us or a third party to perform a credit check on you;
e) add your active debit/credit card information for purposes of making the initial payment and if you desire to make payments via recurring electronic transfer each month;
f) select your preferred time for the vehicle delivery;
g) read carefully and sign the Vehicle Lease Agreement; and
h) add valid insurance as set forth in the Lease Agreement; you may be able to purchase insurance from our partner or any third party if you do not yet have one.
B. Pay the initial payment upon signing the Lease Agreement;
C. Ensure you understand and agree with these Terms & Conditions by taking the time to read them.
3.2. What does the initial payment cover
An initial payment includes the cost of the first month's payment and delivery fee. The card that you added as your preferred method of payment for the initial payment will be charged via Stripe right after signing the Vehicle Lease Agreement in the Ferry App.
3.3. Is there a charge for pre-delivery days
Pre-delivery days are not charged. We’ll apply a refund for these pre-delivery days to your second payment. The refund will be calculated by taking your monthly payment and dividing it by 30 and then multiplying that resulting figure by the number of days between when you signed the Lease Agreement, inclusive of the date of signing, and your delivery date.
3.4. Failed initial payment
We will automatically retry the payment if the first attempt fails to the extent permitted by applicable association and/or card rules. We will contact you if the payment fails after the retry and offer a solution based on your unique circumstances.
3.5. Acceptance of the vehicle order
The acceptance of your vehicle order will be communicated on screen, followed by an email, once you sign the Lease Agreement. The vehicle order acceptance will be followed by an email with a copy of the Lease Agreement that both parties have signed. A copy of the Lease Agreement can also be found in the My Garage section of the Ferry app.
3.6. Declined vehicle order
If we are not able to accept your vehicle order, we will send you an email informing you of this, and you and we will not enter into a Lease Agreement. The reason for this could be, for example, that you do not meet one or more of the eligibility criteria detailed herein or that your selected vehicle is no longer available.
3.7. Changes in the vehicle order
If you wish to make any changes to your vehicle order (for example, to change the vehicle or cancel the order), please contact us at email@example.com. Upon reviewing the request, we will inform you if the desired change is possible. In the event that we are able to do the change, we will inform you about any changes to the initial payment which would result from the requested change, and ask you whether you want to proceed with those changes. Should you change your vehicle order before signing the Lease Agreement, the original order will be canceled, and a new order will be placed instead. In case you and we already have an existing Vehicle Lease Agreement, the existing Agreement will end on a mutually agreed upon date, and the changed subscription terms will be subject to a new Vehicle Lease Agreement.
Subscriber agrees that Ferry may contact Subscriber with regard to such matters using any of the contact information provided by the Subscriber.
When the preferred delivery date is selected, as specified in clause 3.1. (f), you will receive an email and a screen notification of the delivery confirmation. It will be delivered to the address specified in the Lease Agreement and, notwithstanding anything else herein, you may not change the delivery address.
4.1. Delivery day
As per the Vehicle Lease Agreement, the vehicle will be delivered on the date previously agreed upon. A reminder about your delivery day will be sent to you via email, screen, and app notification on the day of delivery.
We will ensure that on the delivery:
a) the vehicle meets its manufacturer's standards, taking into account the mileage and age
b) the vehicle is clean and well-maintained
c) upon request, Ferry representative will walk you through the Vehicle’s layout and features
On delivery day, you need to follow these instructions:
a) make sure you are present at the time of delivery; we cannot deliver the vehicle to an unauthorized person and no power of attorney is acceptable;
b) inspect the vehicle and inform the delivery team of any defects or issues identified; in such cases, a Vehicle Condition Report will be prepared;
c) read the Ferry Vehicle Acknowledgment Report carefully and sign it to certify that you have inspected, accepted, and received the vehicle; and
d) check the vehicle status in the My Garage section in the Ferry app and follow the instructions to swipe, and virtually “park” your vehicle; once you do, you can begin tracking your subscription, including the days of your lease term and your payment history.
4.2. Changes in the delivery date
In the event that your delivery time needs to be adjusted, you will be notified as soon as possible. The changes can result from unexpected and unforeseen circumstances, including but not limited to, weather conditions, sudden technical or logistics issues with the third party appointed by Ferry. If you wish to make any changes to your delivery date, please contact us at firstname.lastname@example.org. Upon reviewing the request, we will inform you if the requested change is possible. In the event that we can make the change, we will inform you about your options and ask you whether you want to proceed. If you decide to proceed with the change, you'll receive an email and app notification as a confirmation.
5.1 Mileage usage
Regardless of the chosen term, your Lease Agreement allows you to drive 1,000 miles per month without incurring additional charges. Unused miles will 'roll over' to the following month (accrued mileage for your account). If you exceed the mileage limit during any one month, including any rolled over miles, and you have not purchased additional miles, you will be charged at the rate per excess mile as set forth in your Lease Agreement. If you anticipate driving more than 1,000 miles per month, you can purchase additional miles at a discounted rate if you wish to avoid paying higher mileage fees. Any unused miles, including additional purchased miles, will expire at the end of the lease.
5.2. Roadside assistance
Most cars automatically come with standard roadside assistance, which usually includes towing, battery jump-starting, flat tire repair or inflation, gas delivery (which varies by make) and lock-out service.
If you need roadside assistance, such as, but not limited to, assistance in connection with a breakdown, you will need to first ensure your own safety at the site and, then, contact Ferry by calling 1-866-971-0866. For roadside assistance outside the return radius, you may be charged transportation costs to return the vehicle to the return radius if that is required.
Any accident involving our Vehicle, which causes property damage or involves third parties, requires an official police report at the time of the accident. Call us at 1-866-971-0866 after any emergencies or safety issues have been handled or reach out to our support team via LiveChat on the app or website
If there is a claim or lawsuit arising from an accident, you agree to fully cooperate with us in the investigation and defense. We reserve the right to suspend your subscription and to suspend your use of our vehicles, at our sole discretion, until an investigation has been completed. In addition, you acknowledge and agree that any accident involving the Vehicle could be reported to the relevant insurance company or other rating agency and remain on your personal driving history for an indefinite period of time.
You agree to acquire a motor vehicle insurance policy covering the loss of or damage to the vehicle in the following type and amount of insurance during the term of the lease:
Liability insurance in the amount of $50,000 for property damage and $100,000 for bodily damage OR has a combined single limit of $150,000 for bodily injuries or death and property damage. The deductible on any such policy may not exceed $1,000.
You are required to add us as an additional insured and loss payee to these policies and, if we so request, you must provide us with a copy of the policy and proof of payments of premiums. The policy must also provide prior written notice to us of cancellation, lapse, or expiration. We shall be entitled to receive all insurance proceeds collected under the policies to satisfy your obligations under this Lease Agreement and to the extent permitted by applicable law. Additionally, if money becomes available from another source as a result of the Vehicle being damaged, stolen, or totaled, we will be entitled to such amount as necessary to satisfy your obligations under this Lease Agreement and to the extent permitted by applicable law.
If you have not maintained the required insurance under this Lease Agreement or if you have, but the insurer will nevertheless not pay the claim for whatever reason, you will be responsible for the early termination liability as set forth in the Early Termination section in the Lease Agreement.
6.1. What happens if you don’t have an active insurance policy
Once you sign the Vehicle Lease Agreement, you will be asked to add your insurance policy number, which is a mandatory step in the vehicle order process. If you don't have an insurance policy at the time of ordering the vehicle, you can purchase one from our partners or choose any other third-party insurance company. If you do not have insurance or you do not purchase insurance, we will cancel your vehicle order. We will refund the initial payment to you in its entirety and you will not be responsible for any early termination liability.
At the end of your lease, you will be able to return your vehicle to a Local Vehicle Compound of our partner at no additional cost. By using our Ferry app, you can submit a request and receive confirmation of the date and location. The vehicle could also be collected from your home by a third-party partner assigned by Ferry and for this service, a fee would be charged.
The vehicle should be returned to us in the same condition as when it was delivered, less ordinary wear and tear. We will conduct a thorough inspection of the vehicle to ensure that there's no excessive wear, damage, or missing original equipment and take a final mileage reading. You will receive a valuation report a few days after the inspection letting you know if there are any issues, as well as a final bill for any items that are billable.
Billable items include but are not limited to excessive wear, damage, and excess mileage that has not been covered by purchasing additional miles.
By way of example, upon the vehicle’s return to us:
a) the vehicle must be in a clean condition;
b) the vehicle must be equipped with all provided accessories;
c) the vehicle’s battery level must be at least 80%;
d) all keys, fittings, equipment, and service booklet must be included;
e) the vehicle must be free of any belongings of yours or any other person’s; and
f) all previous damage to the Vehicle has been reported to Ferry.
Neither we nor our employees will be liable for any personal property left in the vehicle by you or anyone else.
Prior to delivery, we will install a telematics solution in the Vehicle at our expense. To the extent permitted by law, each of our vehicles is equipped with technology that, among other things, allows us to track its location and be alerted to certain driving events. Our goal is to offer subscribers excellently maintained vehicles. Our tracking of mileage and usage allows us to ensure that our vehicles have been maintained properly and are being used correctly. Additionally, it allows us to anticipate the need for maintenance before urgent action is needed and monitor any drivers who violate the law by mistreating our vehicles in a way that would cause abnormal wear and tear.
It is not possible to view captured data in your user account, but a data report can be provided upon request.
Unauthorized removal of the telematics device may result in a charge and a contract termination. We also reserve the right to terminate the contract or to issue an advisory warning to subscribers who repeatedly drive our vehicles in an unusual manner or who have damage incidents at an unusually high frequency.
